I have a drink driving conviction and a police caution - I am now able to do the rehabilitation paperwork.

I do not think that the rehabilitation process will be a problem, it might be lengthy but I think the problems will be with our actual application.

---

Here's my history:-

June 09 – I met my partner in Asia – we were colleagues at a school teaching English. I taught for about two weeks before I decided to leave due to disliking the work and the city. My partner also left about the same time as I did but worked there for about 5 months. She returned to Canada to finish her degree and I returned to the UK.

July 09 – Sept 09 – was in a long distance relationship, contacted one another more than once every day.

Sept 09 – Flew to Canada to be with partner. I was granted a 6 month visitor visa at the airport but stayed in Canada for 10 months (4 months overstay). I worked construction jobs and was paid cash. Became engaged with partner.

July 10 – Flew back to UK with partner for 1 week. Then returned to Canada (again, granted 6 months visitor visa at airport) and got married in a church with our family and friends in Canada late August 10. Stayed for 11 months (5 months overstay) before we went to UK.

Sept 11 – Both moved to UK (partner’s stay is legitimate due to her father being born in UK) and have lived together ever since.

----

I would much appreciate any comments on my situation and guidance as I am very confused as how to approach the application with a history like this.

Thank you, thank you, thank you,

Steve
With two overstays and working illegally, I think this is beyond the scope of a bunch of laymen on an internet forum tbh - your best bet is to contact an immigration lawyer asap.

Good luck.

Definitely get an Immigration lawyer and hope for a lenient IRB member to hear the case if it gets that far.
