Default Spousal Open Work Permit

Hi Everyone

Need clarification on this :

Guy comes here on a TWP - does his spouse automatically receive an Open Spousal Work Permit.

Sorry have been here quite a while now and I know that these rules change - in the past it was skilled workers who automatically got an open work permit for their spouse and then they introduced the law where truckers wives could automatically get an open work permit.

Sorry, no concrete answer but it will depend on the job.

That was a pilot program and has now ended, so if it's a trucker you're asking about, then no, their spouse can't get a SOWP.

No unless the TWP holder holds a NOC skill level A, 0 or B skill level or as stated below from this link

However, your spouse or common-law partner may be able to apply for an open work permit—allowing him or her to accept any job with any employer—if you meet these conditions:

you are
allowed to work in Canada for at least six months,
doing work in Canada that meets a minimum skill level (usually work that requires at least a college diploma) and
doing a job listed in Skill Level 0, A or B in the National Occupational Classification.
If your spouse or common-law partner gets an open work permit, it is normally valid for the same period as yours.

International Mobility Program: Open work permit

In some cases, your spouse or common-law partner will need a medical exam.

The SOWP for truck drivers was for only certain PNP programmes or I believe some had a pilot programme for specific provinces.

Thanks Guys - that is how I remember the pilot and Alberta was part of the pilot.

So the conditions are you have to meet all of them? At least 6 mths, skill level adn A.O and B skill levels?

I cant remember without looking at my old work permit but would you happen to know if a persons skill level ( A O or B) are noted on a TWP?

The NOC code is entered on the TWP e.g. 1121 and from that you can determine the skill level from the NOC matrix
