Default Skilled Worker Class App - help!

Hi everyone

I'm hoping that some of you may be able to help me out with some advice. I appreciate that my questions could probably only really be answered by immigration officials but you never know so here goes...

My girlfriend and I are applying for PR under the Skilled Worker Class but it's looking like we might be short of a few points.

This is probably a stupid the principal applicant I have 77 points. Does my common-law partner of 9 years also have to meet the 75 point requirement to apply as a family member?

We've looked at the section for 'Adaptability' and in particular the 'Relatives in Canada' element. Depending on how you interpret CIC's use of grammar and its definitions for family members it looks like Nikki may well gain 5 points for having a cousin who is a PR living in Whistler. Is this correct or are we clutching at straws in thinking that cousins count?

The real sticking point for us is the ability to prove proficiency in French.

I've studied the CIC documents and the application "strongly recommends" that we take a language test to prove proficiency or provide supporting documentation. Do you think this is necessary, particularly as we are planning to move to Vancouver? If we pointed to this fact in a supporting note do you think it would make a difference? I'm ok as I have an 'A' grade at GCSE French and also completed the first year of the 'A' level course but my girlfriend can't speak a word!

If only we'd applied before June 2002!
