Default UK to Canada move- Temp Work Visa to PR

Hi all, I'm new to the forum, and am looking for some advice.

My family and I are looking at moving from the UK (Wales) to Canada to live.

I've checked the EE program and whilst we have enough points there, we won't have enough points in the CRS pool (only about 350).

My husband is looking at getting an inter-related company transfer for his job, my question is, can we move there temporary on a temp work permit for his job, and then apply for PR once he has gained enough Canadian work experience to up our CRS points?

We are both 34, he has a job offer, I have BSc degree and my work experience is in local government which is part of the federal skills jobs list.

We both have English as our first language (no french speaking).

Also, can our family move there on a temp basis if my husband gets his transfer, or will it just be him?

I have tried Searching the forums but the other scenarios don't quite fit.

Thanks in advance guys.

Yes its possible providing he meets the Intra Company Transfer criteria.

There are several links on this page I suggest you read them
https://www.canada.ca/en/immigration...ansferees.html

Which part of the ICT is he looking at? Executive Manager, Senior Manager or Specialized Knowledge?

From one of the links
are being transferred to a position in an executive, senior managerial, or specialized knowledge capacity;

Ah, I think from reading this he wouldn't meet the criteria for the inter company transfer. He'd have to transfer and have the company do the LMIA, which from what I understand isn't cheap, nor a guarantee that he'd get the position... He's been told that he can have the transfer by the British Office of his company, but I'm wondering how much they have actually liaised with the Canadian head quarters before telling him this....

If they do the LMIA and he can go over on a job offer, will the same apply? As in will we be able to move there temporarily and then apply later for PR? I'm also unsure of how long of a work permit would be granted, as I read that they will only grant a 1 year work permit for low paid jobs after the LMIA; now I don't class his job as low paid, but I don't know if they would (it's a skill class C on the jobs list).

There's so much to get your head around!

Yes, absolutely. That's if he's eligible for the ICT work permit route, from what you've said (about him being a Skill Level C job), I would assume he's not, but this Wiki link explains it all quite well. http://britishexpats.com/wiki/Intra-...ransfer-Canada

What 'federal skills jobs list'? There is no list of eligible occupations, but if you can clarify, it might be that your job is more likely to get you to Canada that your husbands.

You can all go, for the same duration as his work permit, and would be able to go on his PR app too so you'd all end up with PR - this is assuming that by 'family' you mean you and dependent children, no others.

However, one thing to note if he's in a Skill Level C job is that unfortunately you wouldn't be eligible for a Spousal Open Work Permit (if he was in a 'skilled' job you would, you'd then get an open work permit for the same duration as his work permit so could work for any employer freely). So if you did want to work, you'd also need to find a sponsoring employer prepared to go to the cost/hassle/paperwork of a LMIA app, or wait until you get PR.

So again, your job may be a better option, as if it's skilled your husband would then get the open work permit so could work for his employer without them having to do the LMIA app.

What is his NOC code? That will determine if it's deemed to be a low paid job or not, and will change things as there is a different LMIA application for low paid positions.

One last question - whereabouts would you be heading? Your husband won't be eligible under EE if he's a Skill Level C either, so you'd need to make sure that you go to a province where they have a semi-skilled PNP stream - or that you apply for PR if your job is skilled.

Thanks for all the information. Sorry, my brain got full up from reading up on all the different ways we can try to move!

My job is classed as a skill B (administration officer). I highly doubt I'll be able to get a job offer based on my role.

His NOC code is 7441 (he's an automatic and industrial door installer/servicer).

I did read about the skill c low skills work visa and that I wouldn't be able to get an open work permit through him.

I'm unsure how I would be able to get over without a job offer of my own, and it's not the type of job that's exactly sought after!

And we'd be looking at Ontario to move to.

Oh bum. I'm afraid I'm about to be the voice of doom.

It is a low wage position, and even if you could work it would mean you'd be on quite a low income as your wage wouldn't be very high either. How many kids do you have? Just wondering how many in the family those wages would need to support in Ontario.

Your husband definitely wouldn't qualify for the ICT work permit, as I'm assuming he doesn't have skills that can't be found in the Canadian work force or meet the other criteria in the specialised skills category i.e. been sent abroad to train people etc?

I would personally not recommend you move to Ontario, it's not a province that allows those in Skill Level C to apply for PR under the PNP, so your husband wouldn't ever be able to apply for PR unfortunately. You could, if eligible but it's a bit of a risk which personally I wouldn't take with a family, wouldn't want to risk having to uproot them and return to the UK just as you get settled, not to mention losing the tens of thousands you'd have spent on the moves.

I think your only options are to look at another province (does your husbands employer have any other Canadian bases?), or for you to try and get a LMIA and go based on your job so that you know you could get PR and your husband could get an open work permit. As you said it's not likely, but worth a try.

Sorry, not great news all round really.

I was starting to suspect as much. Do you know what provinces would likely be any better? His company is massive so has positions in quite a lot of areas. We picked Ontario as we have friends already living there. 😔

What's the PNP?

(We have one son aged 9.)

It's so frustrating.

PNP - Provincial Nominee Program.

Iirc NS, MB, SK and NB all allow Skill Level C workers to apply after a certain amount of time working in the province.

Alberta and BC also have semi-skilled streams, but they're for specific in demand occupations and unfortunately your husband's job isn't among them.

Thank you so much for your help, o really appreciate it.

Looks like I'd best find out if someone wants to go to the expense of hiring an Local Government worker!
