Default Self emloyment with spousal TWP

Here's a tricky one for ya

There's still a chance that Ailsa could get an intra company transfer, and get a TWP.

Now I know this would mean that I can't work till our PR comes through, but would I be allowed to carry on my little home internet based business? (selling artwork)

I know I would have tax to pay, that's not the issue, it's whether or not I would be legally allowed.

It's not like I'm taking a Canadian's job from them, since it's all my own work.

Anyone had any experience in this?

Is her occupation not one that would allow you an open work permit then?

Depending on your OHs occupation you may be eligible for an open work permit if the occupation is listed in the 0 A & B of the NOC matrix

"What kind of activities are not considered to be “work”?
• An activity which does not really ‘take away’ from opportunities for Canadians or permanent
residents to gain employment or experience in the workplace is not “work” for the purposes of
the definition."

Ahh, ok, I thought that just applied to PR (which we have sent off for)

So basically if/when she gets a TWP, I can apply for an open work permit at POE, since her job does fall under the required NOC list

Or, I can just do my own thing from the house and pay my taxes at the end of the year.

It's all good

Just need to get there now

You would definitely be eligible for a SOWP, so you can work. As she'd be going on an intra-company transfer, she must be either an executive of the company, a senior manager, or have very specialist knowledge, so therefore would be classed as a 'skilled' worker and you can get a SOWP.
