Residency requirement PR
Is residency counted for the five years prior to the date of applying for new PR card?
Or do the 730 days have to be in the five years from first landing?
Daughter with PR lives and works in Canada now but will be about 4 weeks short if counting the five years from first landing date.
Thanks

Re: Residency requirement PR
It’s a rolling 5 year period from landing. So she needs to be able to count backwards 5 years from any date and have spent 730 days there.
Edit: just realised she’s in Canada now! So she’s been admitted as a PR and is fine. She just can’t leave Canada (or apply to renew her card) until she’s got at least 730 days now.
HTH.

Re: Residency requirement PR
She lives in canada now…but is currently out of the country to attend her graduation.
It seems she had miscalculated and didn’t realise the shortfall until after she’d left Canada…
We will be 5 years from landing in April 2023.
She could return early from her trip and make up the missing days. Wondering if this is necessary or not.

If she left it and then tried to enter with less than 730 days there’s a chance it will be noticed and potentially proceedings could be started to revoke her PR. So personally I wouldn’t risk that, I’d just get back asap.
And then suggest she stays in Canada until she’s got far more than the 730 days counting backwards before trying to leave again!

Ok, so if she returns now she’d meet the residency requirement? If so, I’d advise she does that.

I have another related question I’ve posted separately…but it looks like the most sensible low risk option is for her to cut her trip short.

Yep, saw that, but even if she can get those 4 weeks back it sounds like she's cutting it really fine so personally I wouldn't be staying in the UK unless it's for absolutely vital reasons. She needs to realise that if she is that close to the limit she won't be able to leave Canada until she's got another 730 days safely behind her, which means she can't leave in an emergency.
