Just wanted to update this thread as I hope it might help others.
After all the stress, I actually won the court case. The judge decided after a 4 day hearing that we could take my two children to live in Canada.
Thanks to all of you who helped me get through the rough times I suffered this time last year.
We are now set to go for our medicals next week and hopefully the visas won't be long after.

do let us know how it went etc you and I are on the same timescale we had meds last friday but in canada so you will likely get your results to chc before us
