Rejected by pre-approval team in Canada need advice re.embassy in London visit...
Hi Guys & Gals,
I had a job offer in Nov as a Credit Controller in Vancouver. A solicitor's firm called Green and Spiegal was dealing with my pre-approval, it got rejected stating the reason they dont think i have the specialised knowledge to work there. Its not a job issue as i am doing exactly the same job in London. I have 76 points on the calculator too. Now the person who offered me the job says that i may have to go to the embassy in London. No words describe how gutted i am for me and my family. I have read that its not that hard to get a visa in Vancouver when you have a job offer and enough points and didn't think it would be so hard. We have lots of friends who are eagerly waiting for our arrival. I will add that I am british of Caribbean origin but before anyone gets too excited im not one of those jumped up pull the racist card out people but does anyone think this may be an underlying issue as i had to send my passport page off. I really didnt want that to cross my mind and i'd like to say that it's outrageous but crossed my mind none-the-less. Just being honest. Has anyone got any advice on the next step or tips for when i go to the embassy?

Exactly what were you applying for? I can't make it out from your post, you say it was 'pre-approval' but I don't understand what this means. Was it the LMO, AEO or the actual Skilled Worker visa? You mention the points, so are you wanting to go as a Skilled Worker, or on a Temp Work Permit first?
And btw, the embassy in London will not be able to help you, you can't just turn up without an appointment (and they don't make appointments for general advice type stuff). So don't waste your time going there.

No, your race has nothing to do with it.

The employer mentioned the embassy. I wouldn't just turn up as that would be stupid.

The embassy does not do pre approval. Your employer has to apply for a LMO (this is for most cases although there are some exceptions) and the LMO indicates that the job can not be filled locally hence looking at someone from outside Canada. Once you have a LMO you can apply for a TWP either at the embassy or when you come over to Canada.
WIKI and CIC website are probably good places to start

Thanks for replying. I think you may be a bit confused. I noticed you mentioned the race bit first. The solicitor who was hired by the firm who offered me the job mentioned that they would get pre-approval in Canada first. I am not sure from who to be honest, i guess the embassy who give out permits. Maybe it is skilled worker as the app. was for a Temporary Work permit. Is this different to skilled worker then? What's an AEO? It's difficult because the solicitor is not forthcoming with me probably because im not paying them but always relays things back to the employer so its hard to get much out of her.
The employer mentioned the embassy. I wouldn't just turn up as that would be stupid.

And re: the embassy, I realise it was your employer that suggested it but you seemed to think it was possible and I was simply telling you that it isn't.
As Silverdragon said, there is no such thing as 'pre-approval', you need either a LMO (for a Temp Work Permit), or an AEO (Arranged Employment Opinion - for a Skilled Worker cat 2 application). I assume it's one of those that has been applied for, and you've been rejected on the grounds that there are Canadians that can do the job or perhaps it's not been advertised enough across Canada?
But without you being able to tell us exactly what's been applied for or which visa you were intending to get, it's very difficult for us to help you. Can you find out more info and then update this thread? Then hopefully people will be able to assist.

when the advice was provided to you, "You" make the statement, "I think you may be a bit confused. I noticed you mentioned the race bit first" In your response.
The moderator, was providing you with the answer to your Confusing Question?, does it matter which part of the question you asked, is answered first!
No one (I included), are too excited, by your question, just not sure to what information you are seeking?

Applying to come to Canada isn't straighforward and can be very confusing.
When the company lawyers are giving the information out and you don't know exactly what they are referring to it's even worse!
If the company wants to offer you a position and they intend to sponsor you to become a permanant resident, they have to apply to Service Canada for approval.
http://www.rhdcc-hrsdc.gc.ca/eng/wor...workperm.shtml
The criteria to assess a LMO (Labour Market Opinion) is here
http://www.rhdcc-hrsdc.gc.ca/eng/workplaceskills/foreign_workers/temp_assessment.shtml
It could be that they are questioning whether your job experience matches the NOC (National Occupation) description or that you do not have the knowledge required to do the job in Canada (ie, Canadian rules and regulations).
I wonder if the lawyer was suggesting you may get called to London for an interview (may have to go to the embassy)?
If you could give more detail about how you were applying (and whether permanant residence (PR) or temporary) - Temporary Work Permit (TWP) or Federal Skilled Worker (FSW) - people may be able to offer more advice.

Why does everything come down to race or religion these days?
There are certain races and religions that never mention either of those words when things don't go exactly as they would like.
Can we keep the topic on the Immigration track and leave our baggage at home ?

If you keep in mind that in 2008 Canada admitted the following:- over 29,000 from China, over 24,000 from India and over 23,000 from Philippines - but only just over 9,000 from the UK..............I would say that Canada does not exclude people on race at all. They just want people with the right experience and qualifications - regardless of race.

Thanks to all those who gave positive advice and answered or asked questions without judging. I understand that people are quick to post negative posts as they done understand the situation or what i have been through personally for me to suggest such a thing. I think that if you haven't experienced that and can swear 100% that you can answer with conviction that you should be careful with your comments. I could comment on those posts further but i will leave it there. I thought I had mentioned that the application was for a TWP but I guess not. Also I didnt mention anything about the LMO because i wasn't aware of this not being part of the application, as the immigration lawyer was very tight lipped with me. When you are told my an employer that they will take care of everything once you submit all you can there is not much else you can do. I read, i asked for updates and also is there was anything else i can do.
I did ask for advice which i thought this forum was about? But i guess its a public domain and where all entitled to our opinion. As one of the posters said getting a visa is very confusing and complicated. I can do the job as its exactly what i do in the UK. Apparently, the solicitor firm is organising the LMO now and then if successful i will apply for the TWP on arrival. Again, thanks to those who gave helpful posts. Hopefully the others wont be in a position where they are treated in the way they have done me. God Bless you all.

What are you trying to get at? I'd rather you keep those opinions on a different website. My question was justifiable as i guess you have never fallen privy to any discrimination because you belong to the 'certain race' that never mention either of those words. If you find one ,i'll be happy to join to discuss Race as that was not my only question dear poster.
