Refugee Status procedure after Defection
Hi all,
I'm doing some research... (1) if someone were to defect from Cuba to
Canada what process would be involved in succcessfully gaining refugee
status?
(2)if said person were to marry immediately after defecting would this
change the above mentioned process in any way?
I would appreciate any and all help in anwering these questions. I am
not having success in searching out info on the web that is
pertinent...if anyone knows of some good sites that pertain directly
to the above questions, I would appreciate this direction...
And and all help wold be greatly appreciated...
Tia,
Catherine C.

defecting is one thiing and applying for Refugees status is another
When you are aplying for refugee status you are saying you cannot return
because you have a well founded fear of persecution based on membership in a
political, religious , ethnic or social group in your country. The burden of
proof is on you to make your case. The process can take years.

Applying as a married person is an entirely different process. You cannot
mix the two!

James, thanks for this information. I really appreciate it.

Yes, I understand this, which leads to another question. How does a
defector "legalize" him/herself...I'm going on the assumption that one
can't simply defect and not have to go through a legal process to stay
in the country they defected to???...
Do you know of a web site that goes into a detailed description of the
process involved in either of these two things? (refugee status and
"defector legalization" (for lack of a better term)...I have been
searching and am not having any luck...perhaps I'm not using the
correct search terms...
