Hi guys
Been here 3 yrs on work permit, my employer has lost his contract and therefore we're all out of work. How easy is it to get my name added to my partners work permit as her spouse? And would it be an open permit?
My current permit is fixed to my current employer, until he fires us all.

It depends on her job and classification as to if you would qualify for a Spousal open Work Permit. Normally jobs at NOC classification 0, A & B.

Ok I see,
She's a day care worker, not sure if that qaulifies?

I assume she has an open work permit purely as a result of being your spouse? If so, the two of you are likely to have to apply for TWPs from scratch and go from there. Having been through this before, you know what it entails.

You'll need to look it up (find her NOC code, and then see which Skill Level it is on the Matrix), but as has been said above, if her TWP is a SOWP from yours, then you can't get a SOWP.

We're not on each others permits, we have separate permits. Basically if she was on my permit she would not have been able to work with children therefore she applied for her own separate visa. Her Noc 4214 skill type 4, would I be able to be added to her visa with an open work permit

Yes you could be added to hers then, when does it expire?

Well, she could have worked with children if she'd just applied to change the conditions on her Spousal Open Work Permit and had a medical, but hey! But just double checking, she had a job offer and her employer applied for a LMO? And she has a normal Temp Work Permit with her employer named on it?

If so, then yes, you can apply for a Spousal Open Work Permit off the back of hers.

Can you just confirm that, as the above, she has a LMO and a named employer on her TWP?

If so, then yes, you can flagpole to get your SOWP.

Yes, her employer applied for LMO and her work permit has her employers name on it. Good news has also just arrived, we have been to.d to go for our PR medicals :-)

Cool, so you're definitely eligible for a SOWP which is great. And congrats on the medical requests, hopefully not long to wait now! :thumbsup:

Thank you for your help and advice..

We're looking forward to finally getting PR, seems to have taken forever; although it's only been a year.
