When I went for my medicals exam, I do not remember seeing any thing on the medicals forms which tells about the category I am immigrating. I may be wrong. If that is true, how can the DMP know that it is a spousal case. And that too he should know by proper means to not follow generally set rules.

It's kind of, well, stupid IMO to have to delay an application because
they need to do "more tests;" when, in the end, having diabetes
DOESN'T MATTER with a spousal application!


He could have AIDS, and still cannot be refused a PR visa, due to the
new rules concerning spousal applicants and medical issues.

So, why does it really matter whether or not your husband has minor
diabetes? (unless, of course, it's news to you guys, and in the end,
finding this out now is a godsend!)



It's just one more thing that they do to delay processing. And they
certainly like to delay processing for 7 out of 10 applicants (at
least, so it seems these days).

at the bottom, it says the following:


WHAT'S NEW

Excessive demand exemption Family Class sponsored spouses, common-law
partners, conjugal partners and their dependent children, and
convention refugees and persons in need of protection and their
dependents, will not be refused entry if they have a health condition
that places excessive demand on health or social services.




Also, go to the Gazette link (which reported on the revisions of the
IRPA back in June 2002):

page 257 says "Excessive demand, for reason of a medical condition, is
no longer a bar in processing Family Class applications from a
sponsor's spouse, common-law partner, conjugal partner or their
children"


Page 288 says:

The following modifications have also been made:
the Act exempts certain foreign nationals, including spouses,
common-law partners and children of a sponsor from the re-
quirement to meet the medical criteria related to "excessive
demand". This exemption has been extended through regula-
tion. "Conjugal partner" has been added as a category in the
family class and will be treated similarly to spouses and
common-law partners as far as being exempt from this crite-
rion. In addition, the regulations have been modified to clar-
ify that included in this exemption are: the children of a spon-
sor, including children under guardianship and children who
will be adopted in Canada, as well as children of a sponsor's
spouse, common-law partner, or conjugal partner;
