Question regarding DUI

Default Question regarding DUI

Hi everyone,

I was just asked by my brother whether his friend could get a visa with a DUI on his record.

I said to him that I didn't think it was possible but wasn't 100% sure so I thought I would post this here to try and get a more accurate answer for him.

Are we talking about an actual visa eg non UK citizen to visit or the usual want to work here (work permit NOT a work visa) or live here permanently as in PR status.
Was he convicted of the DUI and if so when was he sentenced and to what eg fine only, 3 years probation etc.
If convicted then normally inadmissible for 10 years since completion of sentence in full. Eligible to apply for rehabilitation after 5 years has elapsed.

1. Depends on how long ago, and what he blew.
2. Less than 5 years, requires a TRP, Over 5 years since sentence completed can apply for rehabilitation. If only 1 conviction can apply for a TRP at POE once only. If 10 years have passed since the completion of the sentence, can be deemed rehabilitated.

PMM is absolutely correct about the TRP but CAVEAT it is at the discretion of the examining officer to issue a TRP at a POE. CIC have even made it FREE providing no jail term.
