Question for Mr Miller
Hello Mr Miller
I have a question for you.. Well i have received passport request from
CHC Buffalo and i have alreday sent in my PP for the visa.. Well my
question is if we have a property like a house, appt etc in canada and
then come back to US on a work permit does it count towards the PR 2/5
years period...Becoz i have a property on my name in Canada..

No, it doesn't. Only actual physical presence in Canada counts. The only
exemptions when days outside Canada can be counted as days of presence in
Canada for the purpose of maintaining PR status are when person is:
- outside Canada accompanying a Canadian citizen who is their spouse or
common-law partner or, in the case of a child, their parent
- outside Canada employed on a full-time basis by a Canadian business or in
the public service of Canada or of a province
- outside Canada accompanying a permanent resident who is their spouse or
common-law partner or, in the case of a child, their parent and who is
employed on a full-time basis by a Canadian business or in the public
service of Canada or of a province.
Please see all of the above in the Section 28 of IRPA.
You may have hundred of homes in Canada, but it won't help you if you are
not present here (with above exemptions), period.
