Default Proof of legal status

Hello,
I received a letter requesting to provide a proof of legal status.
Just happened that the status is no longer legal. What will happen
now? Will they refuse my case in this situation?

I assume you are not in your country of citizenship. If so they could
refuse your application to Canada for that reason.

Yes, it is possible that your case may be refused. Why do you think you are
asked for proof of your status?

Being out of status in US doesn't make anyone automatically illegible for
Canadian immigration. But depending on circumstances such person may be
found inadmissible if charged for breaking law in US. Also under new law
person out of status in US cannot apply through Buffalo - application must
be submitted through the visa post responsible for immigration cases from
person's country of nationality.

Andrew is quite right about the law.

However, for now, Buffalo seems to be accepting out of status applicantions
as long as they entered the US on legal status.

I guess their basis for this (until they get further direction) is found in
a situation where a person enters the US on legal status valid for more than
one year when they apply but given the lengthy processing times go out of
status sometime after filing.

In this case the person was entitled to apply so we could argue that they
should have the benefit of completing procssing there.

Will be interesting to see how this goes as more and more security issues
are brought out.

As Berto said - if he would have applied while still legal in US and run out
of status after application was submitted then it should be fine. But he is
already out of status - nobody can guarantee you that case will be accepted
and processed by Buffalo. Your friend may get lucky or may not...

What is the problem with applying through visa post in his home country?
Does he wants to demonstrate to Canadian immigration his disregard to
immigration law and remain in US illegally for next 2 to 3+ years while his
case is processed? Think about it...

compassionate) grounds. This is for people like you. Don't give up.

How come none of these lawyers did not mention this to you.

Such an individual would be eligible to apply in the USA only if the original admission to that country was for a period of one year or greater, even though status is no longer intact. Admission for a shorter period would typically preclude submission to the USA in such a case.
