Port of Entry with LMO - refused?
 
Hi Everyone,
I need some advice. My situation is I have a firm job offer in Alberta. The job I am told by the companies immigration attorney has LMO 'pre approval' - what ever that means. The attorney, working for the employer, is now in the process of applying for the formal LMO in my name. They have adviced that I will get my Work Permit at port of entry when I start work in December.

So, I will effectively be resigning from my current UK based employer without actually having a Canadian work permit in my hand and I wont actually get this until I go through immigration in Canada just prior to starting work.

I am a little concerned with all of this as I shall be jobless if, for whatever reason, I am turned down at port of entry. I have no reason to believe I will be turned down but I guess there are no guarantees?

Am I being overcautious? Does anyone know of anyone being turned away with a fully approved LMO at port of entry.

Any advice , experiences would be really appreciated.

Hi

We came over in August 2006 to wait for my LMO appoval. So when we landed at Pearson, we explained the situation and showed them my job offer etc......they gave me and my family a 6 month visitor visa to cover our stay in Canada until my LMO was approved.

Hello

When you come out here with an LMO to get your WP at the POE everyone is in the same situation - its a little like the saying "speculate to accumulate" :eek:

I wouldnt be too worried as if your new employer has a lawyer dealing with this issue then the lawyer should give you step by step instructions as how to deal with CBSA - I know that ours did.

Thanks for the reassurance Pete & Gaynor, it is a bit daunting, fingers crossed everything should be okay.

Same thing happened when I started out here 18 months ago. I worried about it for weeks. I received a HRSC (? I forget the actual acronym, but the doc that your employer needs to say that they can't find anyone within Canada to do your job...) and handed this in with all my other documentation on landing and walked away with a 3 year work permit.

Still here and almost a PR...

Maybe its a job code that has an LMO exemption?
Look up "Occupations Under Pressure" on Google for BC, AB. SK, ON.
Also look up NOC codes 9990.x where x is 1-7. Eg 9990.5 is an "Information Systems Specialist" (or something).
These job codes have lesser (or non-existent for 9990.x) LMO requirements.
