it shouldn't be, i'm fairly sure they have to release the data within 40
days by law. Although maybe they send you a letter saying you have a record
and it will take longer within the 40 days. Mine without a record took 37
days last year. I guess if you have a record then there's not much point
bothering anyway unless the offence is considered rehabilitated.

I have applied for myself, and a couple of days after i sent in the form with the £10 fee, i got a confirmation letter stating my request has been sent to er, whoever it is.....the letter stated that in the case of there being some history, it would more than likely be longer than the 40 days

heres mine.....you may need to be able to increase the pic size to read

I'm applying for Family Class immigration as my wife of 14 years is
Canadian. I'm confused as to what if any police clearance is required
for my application. Can somebody please advise?

In the Guide to Immigrating as a Spouse the UK is not listed in "Table
1- Countries for which police certificates are required" but in the
appendix D to the guide it gives some (innacurate?) instructions to
obtaining details of your criminal history under the data protection act

Thanks,

Steve

I thank everyone here for the help. I finally got my Metropolitan Subject Access certificate within 36 working days of applying.

Cheers

You're lucky.

The 40 days in which they were obliged to provide my clerance under the
Data Protection Act expired last Friday.

My wife rang yesterday to chase it up and had to hold for 45 minutes to
speak to someone. Every 5 minutes whilst she was on hold the switchboard
reminded her that she was blocking an incoming line and did she really
want to hold?

When she did get through she was told that the check was completed last
Thursday, was clear and that it had been forwarded to the mailing
section to posted out so I should receive it in 10-15 days!!!!!! How
crap is that for service?

Anybody else had a similar experience ?

Steve

My clearance came in 8 days. I guess I got very lucky then. I hadn't
realised things were so bad.

Good luck
