Dear Experts,


Please advise based on my brief background and questions below.


I was a landed immigrant to Canada as of March 30, 2002 and also
have my PR card, SIN and Health card.


However, I would not be able to maintain my PR as per rules - 2 in 5
years which is due this year due to domestic and personal reasons.


Anticipating this, I am preparing myself to re-apply once again so that I can return to Canada in 2006.


Questions:


Do I follow the same process as first time applicant from scratch?


Will my application have any effect from my past?


Do I have to submit explanation about my past failure to maintain PR?
Please advise how I should proceed.


What happens to my SIN card? Does this become null and void? I still
maintain my bank accounts in Canada.


Response to my questions above would really help me.

1. Yes, if you lose your PR, you have to apply again from the beginning.
2. Yes, you previous application will be a factor, CIC will want to know if you are actually sincere in want to emigrate.
3. Your SIN is valid, so if you are accepted a second time, you can continue to use it. Although there is probably something in HRSDC rules stating that if you lose your PR, you are supposed to return the card although I can't find it.

Thank you for your response. I have few more questions:

1) Is there any way I can plead for time as special consideration?

2) Should I apply before my anticipated lose of PR or wait for the 3 year to get over?

3) How can I address this undesirable situation that I am in? Will CIC come back to me for the explanation or do I have to give explanation in my covering letter of my application when I apply the re-aaplication?

4) Do I need a legal counciling for the re-application?

5) Will there be any extra forms that I need to fill for the re-application?

Hi,

One thing to add.
In Schedule 1: Background/Declaration [IMM 0008 SCHEDULE 1] , there is one question (item no. 9) whether you have been previously sought Canadian PR or not. If your answer is yes, then you need to provide detail explanation at the bottom.

Thank you very much. I have few more queries.

1) About legal counseling - I meant, because of this circumstances, will I be able to handle the re-application on my owm? I had done on my own the 1st time.

2) As per the new rules CIC requires Degree manuscripts in sealed envelops. Me and my spouce are graduates of '83 and '85 respectively and requesting for the manuscripts may be difficult or time consuming to retrieve from the archive since they where not stored in the computer system at that time.

Is this mandatory to provide manuscripts in sealed envelop? Last time we had submited copies notorised by a notory public.
