Default Place of application

Dear Miller,

I am on a H1 B visa in U.S for almost a year now and will be here for
a year or so more.Is it okay to apply for immigration to canada from
U.S or from my home country(India).heard that it takes less time in
getting application processed when applying from states(9 months).What
will happen if i move to my native country before my application is
processed fully.Pls advise.

Don't listen to rumors. Current processing time in Buffalo is anywhere
between 16 and 36+ months, depending from many factors. Main factors are -
need for interview, applicant's background, nationality and countries of
residence. There are no cases processed in 9 months, except maybe some very
rare cases processed under Quebec program.

In order to be eligible to apply through Buffalo you must have been admitted
(and able to prove it) to US for at least 12 months. But keep in mind that
if interview is required and you can't get to US for such then your case
will be in jeopardy.
