Hello All,


First of all thanks to the organizers of this website for maintaining an informative forum on Canadian immigration issues.

I applied for PR in April 2001 from India (CHC, Delhi) and came to Canada in Sep 2001 on student authorization to do Master's in mining engineering. After arriving here, I informed the immigration authorities in India and requested them to transfer my file to Buffalo. The process was initiated in Dec 2001 and I have got response from RPC Buffalo in Feb (dispatched Feb 8, 2002) saying that my application has been received and the next decision will be informed to me within next 30 weeks.

But till date I did not hear anything from them. I even sent 2 or 3 facsimiles to know the status, but of no use. Please let me know that when could I expect the next decision from RPC Buffalo about the status of my application.

And, what would be the criterion (whether old rules or new) that they would adapt in my case in assessing the application?

Buffalo is currently assessing applications received in January 2002, so you
still have a month or two to wait for your initial assessment.

Hello Miller,

Thanks for your reply. Incidentally (just after posting my last message), I have got a response from Buffalo saying that they have stopped processing of my application on the grounds that I have not submited the up to date schedule 1 (background checks)
for my-self and my spouse.They informed me to submit the requested information within 60 days, else they will rfuse my application. As I don't want to lose any more time, I immediately filled up all the enclosed forms and kept ready for sending tomorrow.


My concern is: My wife and myself are students here, and our student visas are going to be expired in August and October respectively. I don't know how long the immigration process takes, and I am clueless as what to do if immigration is not finalized by that period.

Anyone, who might have similar experiences may please respond to my quiries with possible solutions (otherthan file transfer to India, as I have already transferred my file from India to Bufalo about 15 months back).

I applied in August 2001 and received a letter in July 2002 stating
that I would be called for an interview. Do you have any idea how much
more time should i wait to hear from the CIC.

You did not tell me where did you apply? I think You know
very well that processing times vary from post to post

I think by now you should have heard something about your interview as you applied well before Dec 31 2001. Those who have applied before Dec 31, 2001 , their cases should have been finalized by the end of March. Since you did not hear anything from them, you should write to them. I also guess that delay might be due to your file transfer from Buffalo to NY.

Now you should somehow findout how long the transefer process takes and when did they actually transferred your file.

Thanks for your information. Could you explain a little bit more why those applications before Dec 31, 2001 should have been finalised? I applied in Sept 2001 through Buffalo, almost the same time as Usman, but still did not receive any letter after the letter of interview waiver back to Oct 2002.

As for your case, I think you should prepare for another 3-6 months for your case to be finalised. If you visa expires by the end of August or October, you may need to find a way to extend your visa for emergency situation.

Hi Gsu0696,


It is due to the fact that at that time we did not know about the new rules. In order to make a difference from the rest of the aplications, CIC decided to consider all the applications that were reached them before Dec 31, 2001 to be assessed as per old rules that too by the end of Mar 31, 2003 with a passmark of 70. If due to any reasons, they are not able to finalize them within the above date, then they would adpot a new criteria to assess your case, but with a low transition pass mark of 70. Pl note as per new rule, who have applied after Jan 1, 2002 should get 75 to qualify

Wrong!

Your statement that cases received before Dec 31 2001 should be finalized by
the end of March 2003 is absolutely untrue.

The fact is that those cases submitted before the end of 2001 were subject
to old law and old selection criteria if assessed prior to end of March 2003
and assessed after March 2003 are subject to new law and new selection
criteria, although with reduced pass mark of 75 points. This is the only
significance of March 31, 2003 deadline, nothing more. Tens of thousands of
applications received before end of 2001 still remain pending after March
2003 and will be processed for many more months if not years.

Well I received a letter from Buffalo in June 2002 and then on July
7th i received a letter from NY saying that i will be called for an
interview. I am still waiting for the interview..i faxed zillions of
times but i dont why they are not responding me at all...what should i
do
