Thumbs up Need a good immigration solicitor

Had been accepted to winnipeg on nominee program but London have refused on inadmissable health grounds, which is due to my 20 yr old son having Multiple Sclerosis. I need a good solicitor who can advice me.
Please Please help

Im not sure what a solicitor can do about medical inadmisibility but perhaps one of the consultants who browse these pages can offer an opinion, Paul Wildy comes to mind as a bloke with a good reputation.

What is needed is to either

(a) argue that the condition would not cause "excessive demand on health or social services in Canada" or

(b)concede that the condition would cause "excessive demand on health or social services in Canada" but provide CIC with a realistic plan to ensure that the Province of your destination will not have to pay the costs or

(c) ask for Temporray Residence Permits for the family instead of Permanent Residence visas

You presumably have what is referred to as a "medical fairness" letter from CIC setting out the case you have to meet?

Medical inadmissibility is a specialised area.

thanks for all your help. It's giving me a headache.What is also annoying is that myself and his brother are also refused.

Sorry to hear this Do you still qualify for TWP as I am sure with some jobs you do not need a medical Surely you still have a valid nomination???

Hiya, I think they have over ruled that, I am sorry but what is a TWP? Myself and my 15yr old son have also been refused because apparently when 1 member has been refused we all are.
How unfair does that sound?

I have a friend who suffers from MS at an advanced stage. His care and cost to the Ontario health system is substantial. He has had the condition for many years now and I'm sure the costs over the years now run to millions of dollars.
There is a reason why immigration was denied.

You may be making some assumptions in this specific case - I know adults who have MS but don't cost the system a lot.

It appears now that this case has gone beyond a response to the medical fairness letter - it is an actual refusal. I would contact the lawyer whose details I gave you promptly, and he will tell you what the chances are of appealing this in Federal Court - and, yes, if one family member is inadmissible then the law is that the entire family is inadmissible - so if you do not, or cannot, go to Federal Court, I am afraid the most you can hope for is a Temporary Residence Permit, not immigration.

thanks firstchoice. I have got my sister who lives in winnipeg to contact them for me. What would be the point of going for temporary residence? You have been a great help

A Temporary Resident Permit is designed to overcome inadmissibility under the Act. I don't know if CIC will grant this - it is discretionary - but it is a possibility.
