Dear lawyers, Can any one explain this situation for my sister and her husband.

Entered Canada as a PR : 8 TH OCT 2001. EXIT CANADA : 14 TH OCT 2001. APPLIED FOR
RRP ( SELF AND SPOUSE ONLY): 02APRIL 2002 RRP VALID TILL : 31 JULY 2002 RRP FOR 3
YEAR OLD DAUGHTER NOT GRANTED.VISA OFFICER SAID THAT TILL 14 YEARS OF AGE IT IS
NOT REQUIRED.

Can any one advise on this aspect .I request Mr Andrew to throw some light on
this. Sandhu.

Officer is correct - minor child under 14 doesn't need RRP.

Dear mr andrew, sorry I didnt put things clearly.My question is do they have to
travel to canada before expiry of RRP or they will automatically come under
2/5 years ( to keep PR status intact) after 28 th june when new rules will be
implemented. Sandhu.

Sandhu:

Because a 3 year old child cannot form the intention to abandon Canada as a place of
residence they normally do not require a RRP however the airline on which they travel
back to Canada may have a problem with this particularly as the parents have RRPs. If
they applied for the child and made a payment i would request a RRP neverthelesss or
a written explanation if one was not given.

It seems that they haven't established permanent residence in Canada upon landing at
all as they just visited here only for one week back in October. So, depending from
what other than 2/5 years residency requirements for the maintenance of PR status
will be established in final version of Regulations they may be in troubles if not
moving permanently to Canada before the expiration of their RRP. They are lucky that
RRP was granted under such circumstances in the first place...

The period of their absence until July 31, 2002 is covered by RRP and after that 2/5
rule applies. But I'm not sure how their absence will be treated if they won't return
before the expiration of RRP - it is a **Returning** Resident Permit after all.

Sorry, a little to fast with the fingers.

The regulations state thatt

(2) Any period spent outside Canada within the five years preceding the coming into
force of this section by a permanent resident holding a returning resident
permit is considered to be a period spent in Canada for the purpose of
satisfying the residency obligation under section 28 of the Immigration and
Refugee Protection Act if that period is included in the five year period
referred to in that section.

This seems to be positive indication that the 2/5 years rule will apply in
consideration of the above.

Would it be safe to assume those who do not have a permit would have been considered
to have not been resident for that time and then applying the 2/5 rule to determine
their residents?
