Default Moved: An estranged marriage question - Please help!!

My brother got married 2 years ago and things havent been going too good with him since then.
He has applied for Canadian PR from New Delhi, India. The case has been in process since 2004. He added his spouse to his application early 2007.

My question is: If he wants to withdraw her application from his, can he do that? I mean, can he take his spouse off his application, without any implications?

He qualifies in terms of points, without his wife.

An expert advice would be appreciated.

Yes, he can remove the spouse, but Delhi will probably insist on proof of their separation.

Does that mean that they have to be divorced before he can take her off? She is not willing to give him divorce but rather making his life miserable.

What can we prove here to Delhi?

As long as he's married and not legally separated his wife, even if changed in the application to a non-accompanying, will have to undergo medicals and other checks.

So, in a jist, he can take her off his application, but she will still have to undergo medicals once his medicals arrive?

The only thing right now is that he wants her off his application and my question was - would he be able to do it without any proofs to be provided to the Delhi HC?

Why on earth would he want to do that?

If he is separating they will want to see some evidence of this, eg legal separation document.
