Default lmo extension

Our one year work permit is up on Dec 2nd and we are going for medicals for PR on Dec 5th. The company have applied for an extension and have had a letter back saying salary needs to be increased so boss and HRSDC are in talks to sort this out. I was wondering providing everything goes ok and we get the LMO extension how do you go about getting the wp, do you need to leave the country again??

You don't have to leave the country to get an extension of your work permit.

See page 20 of Applying to Change Conditions or Extend Your Stay in Canada - Worker. Under the heading of What Happens Next? it states:

You will receive a letter regarding your case and you will be informed if you need to take any further action.

If your application for a work permit has been approved, an immigration document will be sent to you. If your application is refused, you can only stay in Canada until the expiry date of your current temporary resident status.

If you applied for restoration of temporary resident status you will receive a letter advising you of the decision and instructions to follow.

If your application has been referred to a local office you will be notified of this and will subsequently be contacted by this office.

either:

a) send application to Vegreville for processing - takes about 60 days
b) exit then re-enter Canada and get application processed at the border

edit: should also mention that if apply to Vegreville, you can still stay and work in Canada on implied status until a decision is made. Vegreville must have rec'd your application before current WP expires though

Also worth noting that if you do this, you can't leave Canada until you get your WP back from Vegreville, or you'll lose your implied status (i.e. you won't legally be allowed to work). This might be a problem if, say, you needed to attend your brother's wedding in the Caribbean in the New Year.

I think you will find they want your application sent 30 days prior to expiry of existing WP.

Hi Sarah

You don't need an LMO extension. You've been approved for Alberta PNP so the LMO is NOT needed! All you need to do is contact Alberta PNP who will issue you a letter to send in with your work permit application. I can email you the letter I got from BC PNP if that helps.

Only just read this mel. We had approval yesterday for the LMO extension for 2 years and the company have sent off for the work permit today and we have paid all the fees. Should we just leave things now would you say?
