My uncle is living out of status in the USA for more than seven years with a
tourist visa. Can he apply for a immigrant visa in Canada living out of
status in the USA? There are many problems?

Since he is not legally in the USA, he cannot apply for Canadian PR from
the USA. Moreover, his prolonged illegal status in the US may cause
problems with regard to his criminal admissibility.
He can't be living in the US out of status on a tourist visa. The visa
is only how he attempted to enter the US.
