Default Intra-company transfer to Quebec Attn : Jim or Mr. Miller

Hello,

I would like to get opinion and information on next.

Here is the story, US company with headquarters in NY is willing to
open branch office in Canada (in Montreal or Toronto). They want to
transfer one of the owners of company ( Managing partner) to Canadian
branch. However, owner (managing partner of US company is not US
citizen or permanent resident and currently is working in US under H1B
visa).
US company has already contracts ready to sign with canadian companies
to offer services, plus it has secured lease agreement for office
space. Company will be providing Internet services and E-Commerce.

Is it possible to transfer Managing partner of US company to Canadian
branch on same executive position as a intra-company transfer. As far
as I understood from all postings and info,
such person does not require HRDC approval, so he can directly apply
to visa office for work permit.

What are the requirements from new canadian branch and US headquarters
company.
I really appreciate any feedback.

This is a complicated issue that would best be solved through the assistance
of a qualified consultant or lawyer.
