Default Intra-Company Transfer to PR - Help Needed Please

Hi all,

So I've read about through this site loads to help us with the initial Intra-Company Transfer TWP route at port of entry, and it helped us tremendously! Thank you all so much. Been here 3 months to the day now.

So I just need a bit of help with the next step, as I'm not 100% sure and don't want to go down the wrong route. So we're planning to get our PR application in this month. My work will be helping out with it all, but we'll be filling out the forms.

Please correct me if any of my assumptions are incorrect!

So just to clarify, I currently have a 3-year TWP as part of an intra-company transfer (specialised knowledge section) and my wife has an spousal open work permit (albeit it doesn't say spouse, nor does it specifically reference my permit... but it's all the same dates and is open).

We're now going to apply for PR, so I just hoped someone could help me with the next steps.

So I understand that we basically apply for PR off the back of the TWP's, and my work essentially write a letter stating that the job will be made permanent upon us being granted PR. I also understand that an LMO isn't needed because we came under the intra-company transfer route and already have our TWP's.

The NOC code used is in the section 'A', so I believe that helps!

So if someone could talk me through the next steps, I'd really appreciate it!

I found this page: http://www.cic.gc.ca/english/informa...ons/permit.asp

But I'm guessing/hoping this isn't applicable, as it suggests we need to be here for 3-5 years before applying! From what I understand, we're allowed to apply for PR off the back of our TWP's from the day we arrive!

Is this the one we use: http://www.cic.gc.ca/english/informa...ns/skilled.asp ?

In any case, I'm not entirely sure of the process and would really appreciate someone talking me through it... I believe there's been plenty of people done the exact same as me before.

So is it just the normal skilled worker form we fill in? How do we then tie it to our work permits? Where does the letter fit in?

I also believe we'd want the application to go to Ottawa as it should be quicker... do we ask for that, or does it just happen?

Anyway, hope someone can help me with all this as I've not been able to find clear instructions on the process now as it specifically applies to the process after intra-company transfer.

Thanks very much in advance!

Graham.

Managed to find this page:

http://www.cic.gc.ca/english/immigra...employment.asp

This certainly seems to confirm that as we're working here just now on TWP's, and we're in the intra-company transfer route, we can apply.

Just not sure of the exact process, and if there's anything in particular to do as intra-company transferees, etc.

Also, I assume my wife gets PR off the back of mine, in the same way she got an open permit off the back of mine?

Just out of interest, would her PR then be tied to mine? She likes to joke if I ran away from her just now, she'd have to leave the country, lol. As far as I know, her PR would be completely in her own right? This is purely out of interest by the way, we are together forever! :-)

Thanks again,

Graham.

So, I've gone and filled out the application listed here:

http://www.cic.gc.ca/english/pdf/kit...0008ENU_2D.pdf

It does ask what we're here as, and I put 'Worker' for both of us. However, it doesn't ask for references to the permits, or not that I can see.

Anyway, I shall try and stop asking more and more questions. Hopefully someone can come along and answer them for me :-)

Thanks again,

Graham.

The only bits I can help you with are your wife's status.

Yes she gets PR off the back of yours if you are the principal applicant but she gets it in her own right so it can't be revoked if you guys split up or you decide to run off with someone

Hi,
We did this the other way around, so its a bit different! But as far as I know you apply for PR using the FSW2 route, ie: you have arranged skilled employment.

Your TWP is temp only and comes from a different department and is for a temp job only. Its not really directly relevant to a pr application other than to prove you are in the country legally. For FSW2 you will I think need your original job offer letter and a letter confirming your job will become permanent if you get PR.

Your application is I think processed in Ottawa because your applying from inside Canada but someone else will confirm this.

Hope this is off some help and good luck!

Hey Ailsa,

Thanks for your reply.

The main reason I wondered about the TWP is because with it being an intra-company transfer, I obviously didn't need an LMO. I believe this then essentially shows I don't need one for the PR app.

On the back of my TWP, it states I should use my identifier with all future correspondence with CIC. Is there somewhere on the PR app I should put this? Can't say I spotted a relevant section, but perhaps I missed it.

At the moment my main frustration is IELTS. It seems that the earliest date in the GTA region is March/April... Seems ridiculous! So I'm e-mailing round the various ones to find out some more info and if this is correct. I really don't want to delay my application till then.

Thanks again,

Graham.

Hi Graham,
Yes your TWP should help prove you don't need an LMO for the PR application. But the same proof you showed to get your TWP would I think also still apply.

Does the TWP have your UCI number on it, sorry I don't have mine to hand to check that. Your passport number will have details of your TWP in their system already, so they will know and you will no doubt send a copy of your TWP with your application anyway.

Yes I was the same with IELTs unfortunately, I did mine in Glasgow but had to wait over 2 months for the next available date. I also looked at other test centres, but they were all much the same and some even worse. You might be lucky and get something sooner, but best bet is just to get it booked before it slips further.

Hey,

Thanks for your reply again (and thanks Geordie Lass too).

Emm, I'm not sure what a UCI number looks like to know if our TWP has one :-) It just says always use the number from this when dealing with immigration from now on. There is a number with a U at the front (probably about 10 digits long, but I don't have it to hand). Is this a UCI number?

Still got all the documents we used for applying for our TWP at POE, so all good there.

One thing I did wonder about what my university degree. I know it says all documents must be in English. Now Glasgow University likes to write their degrees in Latin, albeit with an English translation in small writing at the bottom. I assume this will suffice (it did for TWP if the officer looked at it)? I'm hoping I don't need to get it authenticated, given the official degree also has the English translation on it. Not sure what the other University's in Glasgow do...

Thanks,

Graham.
