Smile Intra Company Transfer HELP!!!

Hi all
please can anyone help me
I am Currently working for Porsche in the UK and have a Potential Job offer from Porsche In Toronto.
I am going over in Sept to officially meet them.
How do I go about arranging a Intra Company Transfer ?
Is it hard to sort out ?

I am looking to move out to Oakville with my family I have two young children.

Hi,

We're also going to Canada on a intra company transfer and although I have not yet been through it, from what I've read and heard so far you need to do the following...........

1 - apply for TWP yourself (don't need LMO if it's a transfer which is great) so look on the CIC website for the requisite form etc.
2 - get a letter from your potential employer confirming everything
3 - provide proof that you have worked for them for at least a year
4 - provide proof that you fit into the intra-company transfer category i.e. are senior management and/or have very specialised knowledge.
5 - make sure you get everything written down by your company - my hubby is staying on his UK contract (which is great as he'll still get UK benefits i.e. 25 days hols, etc) but we're getting something in writing to that effect.

And they should pay for pretty much everything if it's a transfer so make sure you get that in writing too - we are getting shipping, a £10k relocation allowance, a reccie trip paid for, car hire and accommodation for a month after arrival, flights back annually, etc, etc.

Hope that helps a bit, do pm me with any specific questions and I'll try and help but bear in mind we've not yet actually done it!!

Do you get a company car?

I'm going over in three weeks on an intra-company transfer TWP - quite easy to sort out, did all the paper work myself, got letters from my employer here in the UK and in Canada. Took 7 weeks for the TWP to come through....

we're here on an intra-company transfer. The process is actually v straightforward, as others have said, so long as your employer puts the right words in the letter. Mine was all dealt with for me by an immigration lawyer retained by the Canadian office, so I really didn't have to do much for the paperwork except pick up the TWP itself. It was a couple of years ago now, but again, if you have specific questions ask away and I'll try & remember the answers!

Key factors should include why you're being transferred (i.e. what criteria) and what the link is between the UK company and the Canadian.

Mine has taken from early March till September - could have been done quicker if I'd really wanted to....

Process is quite simply but only if person fully qualifies for it, all is well and conclusively documented, both companies provide properly written letters, etc..

DE4N didn't tell us what position he has now with Porsche in UK and what position is offered in Canada - without knowing details it is impossible to tell how easy, difficult or if at all possible process will be.

We didn't come over on an intra-company transfer as such - oh is still working for the same company, but asked to work over here in Newfoundland.

In that case, we came through the PNP route - got all the paperwork from company saying they had a job, had advertised it for 3 months and wanted OH. Once we had our PNP certificate, moved over on TWP and currently have application in for PR.

Sorry for going off on a bit of a tangent, but just to point out other ways in case it doesn't work out as a straight intra-company transfer.

The following is from the CIC document I've got (apologies for any spelling mistakes, I had to type it out as it wouldn't let me copy and paste!!), it sets out the criteria for a transfer and you/your company will need to prove that you meet it. Perhaps print it out and start making a list of how all the points in your category relate to you? Basically, you just need to prove that you fit the criteria below and that you are a senior manager at Porsche head office, a senior designer and therefore have specialized knowledge, an exective of the company, etc, etc, (I don't know your job so am just guessing!) rather than just a salesperson in a Porsche showroom or a member of admin staff.

The following categories of workers qualify for Work Permits as intracompany transferees:
  • Executives
  • Senior Managers
  • Specialized Knowledge workers

    Executive Capacity

    Executive capacity means that the employee primarily:

    • Directs the management of the organization or a major component or function of the organization;
    • Establishes the goals and policies of the organization, component or function;
    • Exercises wide latitude in discretionary decision-making; and
    • Receives only general supervision or direction from higher level executives, the board of directors, or stockholders of the organization.

Managerial Capacity

Managerial capacity means that the employee primarily:
  • Manages the organization, or a department, subdivision, function, or component of the organization;
  • Supervises and controls the work of:
  • - other managers or supervisors, professional employees or manages an essential function within the organization, or a department or subdivision of the organization;
  • has the authority to hire and fire, or recommend these or other personnel actions, such as promotion and leave authorization; and
  • Exercises discretion over the day to day operation of the activity or function for which the employee has the authority.
A first line manager is not considered to be acting in a managerial capacity unless the employees who are being supervised are professionals.

A manager does not primarily perform tasks required in the production of a product or in the delivery of a product.

Specialized Knowledge

Specialized knowledge means:
  • Special knowledge of the company's product or service and it's application in international markets; or
  • Advanced level of knowledge or expertise of the organization's processes and procedures.
Knowledge which is widely held or related to common practices is not consider specialist knowledge.

A worker who has specialized knowledge:
  • Possesses knowledge that is valuable to the employer's competitiveness in the market place;
  • Is uniquely qualified to contribute to the Canadian employer's knowledge of foreign operating conditions;
  • Has extensive prior experience with the employer;
  • Has been utilized as a key employee abroad in significant assignments which have enhanced the employer's productivity, competitiveness, image or financial position.

The only stumbling block I can foresee is that I am a sales executive and not a senior manager, I have however been there for seven years and have specialized knowledge in our exclusive cars ie Carrera GT,
I hope this would suffice to get me through the process.

It would indeed - you'd just need the Canadian wing to document this in a letter - that you have extensive knowledge of models x,y,z and it would be too time consuming/expensive to train a Canadian in said knowledge and that you are required in order to pass on this knowledge...

I hope it will suffice too. The only question is how specialized is the knowledge? As it says above 'Knowledge which is widely held or related to common practices is not considered specialist knowledge.' - so is the knowledge of the car something held by a lot of salemen or unique to only a few including you?? That may decide it.

And the last sentence - 'Has been utilized as a key employee abroad in significant assignments which have enhanced the employer's productivity, competitiveness, image or financial position', make sure you can document something to prove the relevant 'significant assignments'.

Just something else to check too - when you say you are a sales exec do you mean with a Porsche dealership? In which case is the employer in Canada actually the same company or just another Porsche dealership (or consessionaire) that is owned/operated by a different company?
