With the new regulation on June 28, 2002. Is there a inland immigraiton application
for spouse? (i.e. staying in Canada while applying permanent resident?

New law created the separate class for spouses of Canadian citizens and PR applying
from within Canada. No more need for use of Humanitarian and Compassionate route.

So that with the new regulation, my spouse can apply while she is in Canada? Because
with the new regulation, Finace is being eliminated from the Family Class.

For in-canada spousal class, spouse must have legal status. If not H.& c. is the only
route, but it appears that marriage in itself will not be sufficient for processing
in Canada.

It was also the case under old law - sponsored inland spouse had to maintain valid
legal status in Canada at all times, so nothing changed in that respect in new law.
This is what requirements are:
124. A foreign national is a member of the spouse or common-law partner in Canada
class if they
(a) are the spouse or common-law partner of a sponsor and cohabit with that sponsor
in Canada;
(b) have temporary resident status in Canada; and
(c) are the subject of a sponsorship application.
