Default inland Application

my fiance and i just got married and want to apply for PR from within.
Are the humanitarian forms the best to fill?? how long will it take
to be approved?

There is no more need for H&C application to sponsor spouse from within
Canada - new law created separate class for that purpose. See here for details

So does that mean there was no other way to apply but H&C for spouses
applying from within, that applied before the new laws? and if ones
application was already in before the new laws applied, what happens
then?.

Yes, under the old law all spousal inland applications had to be accepted on
H&C grounds.
