Default HRDC Confirmation question

I'm a U.S. citizen working in Canada as a skilled worker under NAFTA.

My employer offered a full time position and from my understanding they
have to file for arranged employment at HRDC."the foreign national will not
be working in Canada before receiving a permanent resident visa"

The other option is for temporary foreign worker, but HRDC will conduct
market research or something to make sure there is no qualified canadian
blah blah..

So, what I'd like to know is, is it possible for my employer to file for
arranged employment option at HRDC even though I'm already working in Canada
without HRDC validation?

Also, they wanted to know if that offer is binding.
