Default Immediate Response is required and appreciated.

Hi everyone,

Please see this thread for my LMO application details.

Basically, my current employer requested LMO in order to extend my work permit. They also included a cover page regarding the company, my position and why they have not included any recruitment efforts. Currently, I am on a post-graduate WP and we wanted to use the new policy by HRSDC for foreign workers like in my condition. It says that the employer does not need to show recruitment efforts in order to extend the WP of a post-graduate of Canadian institution.

Today, my employer received a fax from HRSDC and they requested the following.

1-Start date
2-Proof of recruitment activity
3-Copy of my degree from Canadian institute
4-They are saying that my wages are low and it should be like $4/hr more in my region.

Now, my employer has no problem with the wage increase since they want to keep me but they just don't have any proof of recruitment activity for this position since I am already working for the company.

They want an answer in 2 days, I would appreciate Mr Andrew and others who are experienced in these topics to contribute as soon as possible. Thanks a lot.

Tom

Unfortunately the "new policy" mentioned above doesn't exist on HRSDC website, at least I can't find it. This is what is happening when you rely on third party "news" instead of checking with the source - HRSDC and CIC directly.

Ask employer to call HRSDC about your case and to ask about the "new policy". Maybe it exists and I'm not only one who can't find it, maybe HRSDC office processing your LMO cannot find it too...

I called Service Canada number in Toronto and I inquired about the new policy. They told me that my employer can submit the application without recruitment efforts and if they need it, they would ask for it. So I assumed that she knew about the new policy and it was just a standard line to say what she said at the end.

Anyways, I have seen this "new policy" in these places as well:
http://www.lexpert.ca/directory/rd.php?area=G1http://Third topic from the top.<br ...ne/000247.html

http://www.gowlings.com/resources/ne...ter2007.en.pdf Page 6, right side second paragraph.

http://www.sdc.uwo.ca/int/visa/index.html?work_hrsdc Check this one especially for an operational guideline!

Of course you got a generic answer telling you really nothing. And none of links you provided is from HRSDC site, all are third party links. Thus I'm still sceptical and request your employer got from HRSDC only proves me right so far.

Are you not at list a bit concerned that search on HRSDC site cannot find this "new policy"?
