Hi,

If someone can help me understand something. For H & C applications, which are
processed in Vegreville, Alberta, are Immigration Officers there more 'sympathetic'
towards these cases than the regular Independant Class type cases? What im trying
to find out is that I see from the CIC web site that people filing for H&C must be
over the age of 19. What if somebody is younger than this age? Will they go by the
rules as stated, and nothing else? My friend is 18, turning 19 in 4 months. Will
they look at her case, and treat her as if she was 19 or does she not have enough
grounds for H&C ?

H&C applications are perhaps the most difficult as the immigration officers have the
discretion to accept or not accept certain conditions as being humanitarian or
compassionate. The department has a policy whereby marriage to a CC or PR is deemed
to be satisfactory for processing in Canada provided the marriage is determined to be
genuine. There is no policy relative to H&C cases whereby they will accept a single
parent but not both parents etc. It is very much a case of providing as much
information as possible in order to allow the officer to make a reasoned decision.
No, they will not look at her as if she was 19 she must meet the requirements of the
legislation when she files the application. Wait the 4 months. Ron Beirnes

Sounds a little too complicated for as simple note. Perhaps a = consultation with
some professional would be a worthwhile venture.=20
