How to be in legal status in USA, while waiting for the PR from Buffalo, NY.

Default How to be in legal status in USA, while waiting for the PR from Buffalo, NY.

Freinds,
I applied under skilled worker category.
Received the AOR on Jan 8,2002.
Received the medical papers & interview waiver on Dec 12,2002.
Asked us to wait for 6 months to go to medicals.
Sent Finger prints on Dec 14,2002 & they are in my CAIPS file by
Dec27,2002.

I am on a H1-B visa here in USA, expiring on July 9,2003.
I wanted to finish the medicals by June 12,2003 and stay here till I
get an answer from Buffalo office, say till Nov 2003.

What options I have ??
1. Get back to F1 visa ( which is not easy these days )
2. I may get a transfer in our company's Canada operations. They don't
want to loose me as I don't want to leave the company too. If I enter
Canada under Job visa, will that affect my PR application ?
3. ????
4. ?????

Please advice !!

Has your company applied for your Green Card in the US? If yes, you can file an extension for your H. Otherwise, if your company transfers you to Canada, you might be able to get additional points (for Canadian employment), I believe. However, I'm not sure how it'll work out, given your rather tight timeframe.

Do you need to work, or do you have enough money to stay without
working until November? If so, just apply for a student visa and
go to school in the USA while you're waiting for your Canadian PR
to come through.

Sorry fiends, I could not able to access the group for the last 4
days. Dont know why ?

I can stay till Nov/Dec 2003 as a student.I am positive that some
position will be there with my current company during that time when I
land in Canada.(May not be the same as now in L.A )

I have 74 points.( Undergrad in Mechanical Engg + MBA from Oklahoma )

So, going out of USA ( to the home country-India )after the medicals
is not a good idea ??
