Further delayed selection decision

Well I tried to consult you once again Sirs because until now my friend haven't heard anything from CIC Manila after being interviewed last Nov 2004. It's making her life miserable. What do you think is happening to her application? Does the Rasolzadeh matter has something to do with her case? I thought an agreement has already been reached paving way for a back-to-normal CIC operation.

There is a settlement but it will take about 4 years to clear all affected cases

Timetable set in the settlement is as follows:

50% of the class, including all applications submitted in 1999 or earlier, will receive selection decisions within 12 months of final settlement, regardless of visa office;

All applications submitted in 2000 will receive selection decisions within 24 months of final settlement, regardless of visa office;

All applications submitted in 2001 will receive selection decisions within 42 months of final settlement.

Mr. Miller,

Would it be alright for Centauri's friend to send a letter asking for their application's status? I could just imagine the stress and anxiety heightened by the agonizing wait of not knowing what the final decision of the officer was after the interview.

Most visa posts don't reply to status requests - but even if by some luck they will reply the answer will be "in process" or "we are waiting for information from other government agencies". There will be no indication of any kind of estimated timeline or result.

Just remember - every such request (not even replied to) takes valuable time from processing officer and thus delays processing further for everyone.

In a similar vein, Mr Miller, may I ask your advice on something?

The AOR gives a time-frame "you may not be contacted for up to ... months", but gives no indication as to what, if any, action is appropriate if this time passes and you do not hear.

I take your point about status enquiries delaying everything further, but with the stories one hears here of people not receiving correspondence which maybe goes astray or someone forgot to send etc ... what would be your advice if this period comes and goes with no contact received?

Would you suggest that the first line of action would be to send for CAIPS notes, and if so, at what point?

1. Contact the CHC about a month after xx months if you don't have anything from them. Send a fax and ask for status update.
2. Check Ecas after xx months.
3. CAIPS is pointless until you get I.A.

Hi Andrew,

I would probably agree with you that making requests to CIC will only contribute to further delays. However in my friend's case she was verbally informed after her interview that she has to wait for the decision on February. A month and a half had already passed and yet there's no buzz from CIC. Is it a good move to send a correspondence at this moment?

The problem is that all pre 2002 cases are affected by lawsuit and settlement - thus whatever officer said after the interview is now irrelevant as circumstances changed.

And the thing to always remember (at least in most cases) - if officer at the end of interview states that interview was successful or something similar (when asked or on his/her own will) then selection decision is for now positive, providing that verification of credentials won't change it.

But in almost all cases when officer at the end of interview answers or states that decision will be made later you may take it to the bank as good indication of coming negative selection decision.

I hope it is not the case with your friend.

Was your PS for me?... Confused if so; I haven't sent my PP anywhere, I am waiting for contact since my AOR feb 9th 2004.

In my case it was similar case, I was interviewed in Nov'04, but before
interview only the lady said she can't say Y or N as per order but will let
me know within 4 months,,,now still hanging,,Mr.Andrew I like to ask you
that court's decision was supposed to come on 18th March earlier and then
on 8th April,,but nothing yet,,,so when you say it should be ? so atleast
we can check with embassy for the status of the file thereafter,,,,

What should I hope for in my case ? that lady told me before starting interview only that she could not be able to say yes or no as per court's order, actully interview went fine and at no stage she was looking unhappy or unsatisfied,,,she just asked me to complete one form at the end and I did it.
should I mean positive or any danger !!!!

Sorry, but I don't know. I have no idea about your case, I didn't ebaluate your application and I don't know what officer interviewing you thinks. You'll have to wait.

I request all of you to post at the earliest as soon as the court's order for pending cases will get cleared,,,I also hope the persons from Manila waiting like me will also keep on updating us,,,sure from myside also

Mr. Miller,
This delay due to the Rasolzadeh matter, does it include those who did not participate in the suit? Does the delayed in selection decision includes all applicants that applied in year 2000? :confused:
