Hey Former Lancs/all..

One of our tenants is an irish guy here on TWP. He's now got an employer willing to help with PR by going through PNP for BC and who has hired an immigration lawyer here in Vancouver on his behalf. His TWP had expired, and he had stopped working, and wanted to apply for a visitor's visa so he could stay until PR comes through (about 6 months). Was going to do it online, but lawyer advised him just to take all paperwork showing PNP in process etc to the border, flagpole, then get visitor's visa there.

Went to Aldergrove yesterday, flagpoled, and got denied visitor's visa and told to leave country in 6 days. Any advice? Can he appeal?

Was he issued a Removal Order i.e Departure Order or Exclusion Order or was he instructed that he could voluntarily withdraw his application to enter Canada?
Normally they have 30 days to depart if given a Departure Order before it becomes a Deportation Order.
Basically no appeal if Removal Order issued at a port of entry as in this case.

It should be an Immigration form IMM 1442 generated by a printer. Form number is on the bottom left corner of the document. The wording has to be read closely to see what the actual document is.
My guess its a Departure Order.
An Allowed to Leave would normally state something like In accordance to section blah blah blah I voluntarily withdraw my application to enter Canada.

Sorry to hear this.

Regarding the PR application, once he has received PNP nomination (8-14 weeks) he can ask for a support letter and obtain a TWP on the back of it, he doesn't have to wait for PR.

PR applications through PNP routes are done in two stages; stage one (BC PNP nomination) takes between 8 and 14 weeks, stage two (CIC PR processing) takes around 17 months if Ottawa was the designated processing office, 27 months if London was.

Lancs, here is the info from my tenant:

No they just wrote the date I had to leave on my original entry stamp. Didnt receive any paperwork, it was all verbal

If that is true then IMHO no Removal Order was issued nor was he asked to voluntarily relinquish his entry into Canada.
What he should do is apply for an extension as per this link.

As for the legality of telling someone they have 6 days to leave without documentation then I won't comment on that.
