Default Feeling lost!

Hiya everyone

I'm feeling quite lost to be honest and frustrated!

My husband and i are wanting to apply for PR. We originally looked into the skilled worker route as we are both PE teachers. We looked at using a migration agency who charged us £150 for an assessment saying we would score highly enough but would need a job offer.

We quickly realised that finding a teaching job from over here was not likely.

Since then My hubby has been offered a full time job in Penticton BC as a hockey coach. Mark has spent many summers at that hockey school when he was younger. But this is what i find most confusing...Would he pass the application with this job offer? He does have coaching qualifications too and i guess being a physical education teacher would also contribute. We are reluctant to use an agency also because many of our friends have told us its possible to do the application ourselves and to be quite honest we cant afford to throw money away.

I feel lost because how do i get these answers before i apply? Do i have to spend the £150 again at a migration agency. Is there somewhere you can call?

Before you applied officially did you know if you stood a good chance? As in having to tell your boss your plans for the application process and then worrying what if the whole thing falls through...

Sorry i have waffled
Thanks Becks xx

Why not just use an immigration consultant that does free visa assessments? Most good ones won't charge you anything at all. Find recommended ones by searching the forum. That way you can check you've got a chance before you fill in any paperwork.

To give you a brief overview though - firstly, your husband's potential employer will have to apply for the LMO to prove they've advertised the job and cannot find a Canadian willing, or able, to do it. Then once they've got the LMO you can apply for a TWP (very easy, only a couple of pages so definitely don't need professional help for that) and head over there - you won't be able to get PR before you go unless your husband's employers are prepared to wait a year or so for him to start!

So go over on TWP, then apply for PR via FSW Cat 2.

Hope that helps.

Teaching jobs are hard to find for PRs, without having PR there is as you have found there is no chance.

A job offer is not enough to get a permit. The employer has to get an LMO approved by HRSDC and show they have tried to hire Canadians or PRs first. To get this there is a set of rules they have to follow to do this. If your OH has a higher skill set and specialised qualification this might work, however I cannot imagine there is a shortage of hockey coaches in Canada.

You could also check to see if your OH qualifies for the Self Employed route http://www.cic.gc.ca/english/immigra.../apply-who.asp

Hiya.

Thanks for you fast replies. The job is not to start until Sept next year and they said they would be happy to hold the job if it took a little longer. So would we still need to do the LMO thing if we didnt go on a TWP???

I guess what i'm confused about is the fact that my hubbies main qualification and experinece is teaching. Although he does have coaching qualification (some in canada too) and the job offer is coaching. Would they marry the two?

Sorry if im coming across clueless. I have spent hours researching and have given myself a headache

xx

You'll still need the employer to apply for either a LMO or AEO if you want to apply for PR using arranged employment - the job offer must be approved by HRSDC.

As you've got a year before he has to start, you can ask them to apply for an AEO instead (slightly less onerous than the LMO) and then apply for PR via FSW Cat 2 as soon as you get it. You'll need to get cracking with it though, as it's likely to take close to a year to get it, so you'll have to make sure you're on the ball with it all (i.e. send stuff off asap as soon as it's requested).

Alternatively, if you don't want to risk not having PR by then, the employer can apply for LMO instead so that he can start work on the TWP before gaining PR.

Another related question,

If you go down the LMO - TWP route, you presumably must stay with that employer for your entire PR application whilst in Canada?

But what happens if you apply from UK with an AOE. Once you "land" and validate your visa after it's all processed, are you in any way tied into that employment for any period of time? Or are you free to quit if it doesn't work out?

Wayne.

Hiya everyone

Confused!!!!!!!!!!

Waggle, he would have to stay in the employment for atleast 1 year. His hopes would be that once PR he could apply for teaching jobs.

Can you start the PR ball rolling whilst here but still go across on a TWP?

I'm very confused, lol!

And the answer is yes, you can apply for PR and then go across on a TWP - loads of people on here have done exactly that. Best to apply for PR asap though if you are eligible, in case they remove your visa category or change the requirements.
