Default Family Class Immigration

hello,

on the page http://www.cic.gc.ca/english/sponsor/index.html i have found some information about who qualifies to be sponsored as a family member. to tell the truth, i've got a bit confused trying to understand the following text:

You can sponsor relatives or family members from abroad if they are:

1)spouses, common-law or conjugal partners 16 years of age or older;
2)parents and grandparents;
3)dependent children, including adopted children;
4)children under 18 years of age whom you intend to adopt;
5)brothers, sisters, nephews, nieces or grandchildren who are orphans; under the age of 18 and not married or in a common-law relationship; or
you may also sponsor one relative of any age if you do not have an aunt, uncle or family member from the list above who you could sponsor or who is already a Canadian citizen, Indian or permanent resident


my question refers to point number 5) - if i am 28 years old can i be sponsored by my sister who with her husband are about to become Canadian residents, assuming that we have parents, uncles, aunts etc., but she wants to sponsor only me?
if anybody has any ideas and could enlighten me i would be very, very grateful. thanks a lot.

Nope, she has a spouse therefor she cannot use #5

No, she can't sponsor you. This exceptions applies only when sponsor is absolutely alone in Canada (no spouse, no children, parents, siblings, etc. who are Canadian citizens or permanent residents) and if sponsor doesn't have any other relative abroad who may be sponsored. Read the exact rule here in section 117(1)(h) of IRPA Regulations:

R117(h) a relative of the sponsor, regardless of age, if the sponsor does not have a spouse, a common-law partner, a conjugal partner, a child, a mother or father, a relative who is a child of that mother or father, a relative who is a child of a child of that mother or father, a mother or father of that mother or father or a relative who is a child of the mother or father of that mother or father

(i) who is a Canadian citizen, Indian or permanent resident, or

(ii) whose application to enter and remain in Canada as a permanent resident the sponsor may otherwise sponsor.
