Default Experts: regarding Spousal Sponsorship and LICO waiver?

To all experts out there... I need some confirmation please....I have heard
that in regards to spousal sponsorship from a Canadian for a Japanese
national... that the LICO is waived. Would it matter if the canadian
citizen who is sponsoring does not make a whole lot of income (below LICO
standard - probabaly about $13K/year) because of their status of being a
student and part time employment? I am not under any kind of social
assisstance (ie. welfare), and live with my parents so room and boarding is
not a factor. In cases like these, what is the likelihood of my spouse being
approved for the Spousal Sponsored PR visa (application from abroad) from
CPC in Mississauga? We have all necessary evidence of a relationship (ie.
photos, email, telephone bills, shared Credit Card account, letters), but
the only drawback in my thoughts would be my low annual income because of my
situation.

Are cases like mine more likey to result in rejection/approval, or would it
not make any difference?
Please give me your most honest opionion? If so, what are my other avenues
in this case? Can I get some notorized letter from my mother to say that
she is more then willing to support my spouse financially if required...
which will not be.

Your case seems likely to be successful. Many others have done exactly the
same thing in the same circumstances without any problems.

Under new regulations there is no discretion in calculating LICO. The requirements must be met for a 12-month period. Persons who do not meet LICO cannot be authorized to sponsor even if they have good employment prospects, extensive assets or relatives willing to provide additional support. Only income of Canadian origin is taken into account.


There are a few exceptions:

If you are a new immigrant and your income in a few month meets the LICO requirement and you can show your pay stubs for 6 month with the necessary amount.

If you commute each day to the U.S.A., but you physically reside in Canada.

If you have foreign investment or income, but you have paid Canadian Income tax for the previous 12 month and are residing in Canada.


Note: The sponsor is not required to meet the above income requirements if he or she is sponsoring a spouse.

Do you think it would help or matter much if I explained the details of my
situation in a letter to immigration, as well as a letter from my parents
offering any financial support... or would it not matter at all to
immigration?

As a former officer, yourself, under what circumstances did a couple get
rejected in circumstances similar to mine?

For a spousal application the LICO is waived, you just have to show your
income, whether or not you meet the LICO. As long as you are not collecting
welfare benefits, other than disability you don't need anything else.
