Hello there,

I have 2 questions ,

1) We are Uk residents applying for PR through Lawyers in Toronto.Application sent to Buffalo.
We have applied as entrepaneurs.We had our AOR in Dec 2002.
Our initial assesssment was due in 30 weeks which was extended to 60 weeks and finally to 66 weeks.The due date for initial assessment was March 3rd 2004.
As they hadn't received anything our lawyers faxed a follow up to the Buffalo Consulate asking for our initial assessment.
They say that we may not hear anything for up to a month and then if they still haven't heard anything they will fax follow ups every month after that.
What is your experience in these cases?
I know that as we are business class that we will have to have to have an interview.Is it likley that our file will be transferred to another office and placed in a queue ?

2) as this looks like it may take many months still,is it possible for us to obtain study permits for our two daughters aged 14 and 6 and go and live in the house we have already bought in Ontario.Whilst our application for permanent residency is going through?
We don't need to work as we have an income coming in from the Uk

Why Buffalo?!!!

It was a very bad choice. If you would have applied through London you would
already have your visas. What made you decide to apply through Buffalo?

And there is absolutely no mandatory interview in Business class anymore,
looks that your lawyers are feeding you some crap. Business class applicants
can get interview waiver too, as long as application package is flawlessly
prepared and leaves nothing to officer's doubts, questioning, interpretation
or clarification. Of course waiver cannot be guaranteed, but if your lawyers
did their job properly you would have great chance for waiver. On the other
hand by submitting application to Buffalo your lawyers made an error as most
out of jurisdiction applicants are called for interview anyway.

Interview if required will be conducted in one of 4 Canadian consulates in
US - NY, Detroit, LA or Seattle. And of course if interview is required file
will be placed in interview queue.

More - we are currently receiving assessment notices with interview waivers
from Buffalo for cases filed in Business and Skilled Workers class in March
2003, so your lawyers didn't do a great job preparing your case if you have
no assessment notice yet.

Yes, you may apply for study permits for your kids and go with them to
Ontario, although you will only be visitors.
