Eligible for EE and living in Canada need some advise
Hi
Having established eligibility via CIC and currently living and working in Canada via IEC ( over 2 years) with a permanent job Does my employer still need to apply for LIMO or is a contract of employment sufficient???
Also once an application is submitted can you immediately apply for an OWP??
Would this be a better route than Common Law Sponsorship?

1. Without the LMIA you won't get 600 points for arranged employment.
2. You have to received an Invitation to Apply (ITA) presently around 450 points or more. If you receive an ITA then you upload your application and once you receive your 2nd Acknowledgement of receipt, that the application is valid, then if your present work permit has less than 4 months validity, you can apply for a Bridging open work permit (BOWP). Note your work permit has to be valid.
3. Common/law is probably easier, don't have to get the ITA and you won't require IELTs/CELPIP nor LMIA. Note though to obtain a work permit under Common/law you have to apply for "in Canada" spousal processing which will take about 27 months to process. It you apply "out of Canada" probably less than a year, but no open work permit.

Hi PMM thank you very much for the information. We are trying to figure out the best way for my daughters common law partner to gain PR. Unfortunately due to recent changes to IEC for Australians they are unable to apply for a further IEC visa so the time scales for them have been drastically reduced. They have been a common law couple for over 2 years now, The current IEC visa runs out at the beginning of September 2016, we have read through the Wiki for Spousal sponsorship Canada are you able to clarify a point for us with regards the pilot progran for work permits... are you able to apply for the work permit at the point the application for spousal sponsorship is submitted or do you have to wait for approval from CIC to sponsor first and then apply for the work permit when the Principal application for PR is submitted ??

1. If your daughter intends to go the "in-Canada" spousal route, the open work permit application is included with the application.
2. Personally, if his IEC is valid for 9 months, there is a very good chance that he would be "landed" rather than waiting for 27 months for the "in Canada" process.

Hi PMM thanks for the quick response can you just clarify point 2 do you mean if they apply via the out of Canada route (London) the process could only take 9 months?? we were under the impression it would take 17 months outside Canada??

How old is he? Are you sure he is not eligible for another IEC participation?
For Australia it says:
"If you participated in IEC before 2015, you are eligible for a final participation of up to 24 months in the category of your choice."

He has already had 2 IEC Visas so has reached the maximum

IMO according to the wording above it is worth creating a profile in the pool for another, final participation if he meets the criteria.
I know of more than one Australian who has 2 or more and applied for the "final participation" one.
Nothing to lose ...

PS if he's an Australian, the stage 2 processing for an outland spousal isn't going to be the London office.

So if my daughter is the sponsor with PR for Canada and a British citizen the application wouldnt be via London?? where would the stage 2 be processed??

I don't know about Oz, but London processing is generally much quicker than the published processing times (see the FAQ for more info).
