Divorce certificate for EE
 
The Immigration office has asked for a copy of my husbands divorce certificate to go with our EE application, after 26 years and many house moves later we don’t seem to have it. He’s asked his ex wife if she has her copy but still waiting on a reply. If she doesn’t and the time to get a copy being 29 days and the time Immigration has given us is 7 days would a letter of explanation be enough? Thanks as always for any help.

It's usually requested for EE if you have put down marital status as 'divorced' according to this: https://www.canada.ca/en/immigration...ess-check.html


Divorce certificate and legal separation agreement

Purpose: To validate marital status claims

Document requirements

  • The divorce certificate is requested only when marital status is listed as divorced.
  • If the applicant divorced in Canada, a copy of the divorce order or certificate of divorce issued by the province or territory where the divorce took place must be provided.
  • If the applicant divorced outside Canada, a copy of a legal certificate issued by the country, the territory or the region where the divorce took place must be provided.
  • A copy of the legal separation agreement must be provided, if available.

If he still needs it he can apply to the Registrar in the UK for a copy, if he has the case number it will cost £10 or £45 if he can't remember the case number but has the year and which court processed it - or £65 if he knows the year but not the court :) https://www.gov.uk/copy-decree-absolute-final-order. Once applied for he could ask for a deferment for submission and show proof of application. :)

Siouxie thank you his ex is going to have a look so fingers crossed she has it. If not we will take you advice and ask for deferment.
