Devistated as study permits refused
 

We had some real bad news this morning,our application for study permits for our daughters have been turned down.
The immigration officer said "On the basis of the documentation submitted, and as you have an application for permanent residence in progress in Buffalo yet to be paper screened, I am not satisfied that you will return to the United Kingdom after completion of your studies."
Obviously I didnt make it clear enough to her thet we would return if our application was turned down.
We plan to go to the CHC on Monday to see if we can talk to someone about it.
Has anybody any ideas. Andrew and Jim your views are also appreciated.
We will have all our household goods left here in storage and also our business which we are leaving in UK with the foreman running it.

Can't give you any advice but I am so sorry to hear about your bad news. That's a real spanner in the works.

We decided not to go down the study route as we must be so close to getting PR and we still have a couple of businesses to wrap up here in the UK and as we are now taking my daughters pony (which is a costly affair!) I wanted to wait until PR is here to avoid any unnecessary expense, so we are not planning on moving out to Ontario permanently until Summer 2005. Will have loads of vacations out there at every 1/2 term and end of term holidays so I am quite happy.

You must be so frustrated! Your PR is taking forever. Hope it all comes together eventually for you.

Sorry about the refusal. I doubt that you will be able to see anyone at the CHC about the refusal. Your only recourse is the Federal Court which is expensive and lengthy, or take a chance and re-apply.

You have to look at from the Immigration perspective. You have basically cut your ties in the UK on the assumption that you will get PR status in Canada. Immigration looks at visitor applications and makes their decision on the question; "is this person an immigrant? or a visitor who will return home?" In your case where you have severed ties with your home, CIC would look at the balance of probabilities that you are actually Immigrants and not visitors.

If we were to re apply, what should we put on the form where it asks if we have been refused a visa to travel to canada ?
Should we say that we had applied before and been refused and explain that we think we didn't give enough details as to our position and have no intention of staying in canada illegaly

you would HAVE to say you were refused earlier... its one of the first things they check for when you apply for a non immigrant visa (if you have or had any other applications in the works and what the outcome of those was)...

Sorry to hear this Alex and Bob. We are about to submit study permits for our two any chance you could answer a couple of questions for me.
1. Can you tell me what documents you guys submitted. Did you send fully completed custodian and gaurdian forms with your application.
2. did you show funds on a UK bank account or a canadian bank account.
3. Did you tell them about property in Canada.
4. Did you show any documents of ties in the UK.

here are the answers to your questions.
1. We didn't submit custodian and guardian forms as we were planning to accompany the children as visitors.

2. we showed funds from both English and Canadian bank accounts.

3. We didn't tell them about our property in Canada, whether we should have done we don't know.

4. We didn't show any ties in England.We wish we had.

We went straight to london and queued to see someone to try and explain our situation.We didn't even get past the receptionist.The lady who turned down our application was there but would't see us. She was too busy!!!
The receptionist recommended that we re-apply to Buffalo where our immigration file is.Trouble is they managed to lose all our original documents so now we have to start from scratch.
This time we will send a detailed covering letter telling them of all our property and business here which we plan to keep running.
We have also sent this letter to the lady in London to see if she may be human after all and reverse her decision.Won't hold my breath though.
We are supposed to be going to Canada on July 2nd but I doubt whether we will have heard from Buffalo by then so we have used our lawyer in Toronto to receive any communication.If they turn us down we will just have to come home end of August and keep trying.

I wonder how would be best to demonstrate your ties in the UK!
