Default Dependant children

Hi This is Nicola 1965

I was wondering if anyone else is in the same postion as my family and i are in . We are submitting our applications for permanet residency and our son is coming up to 22 years old. The embassey webb site says for him to be considered dependant on us he has to be in a full time course. Has anyone else who has applied for this in the last 6moths with a child coming up to 22 had any problems with their application and have they had to have that child on a full time course for the application to be accepted, or to be put through.

Many thanks Nicola 1965

Hi Nicola

I have 2 sons 24 & 19, both at university. The elder one was able to be included on the application (23 at time of applying) as he was still in full time education. He is due to complete his degree in May/June 2010.

Hope this helps

As long as your application is received by CIC before your son's 22nd birthday he is locked in at that age (under 22 is classified as dependant) and does not need to be in full time education. He may not marry or live in a common law situation prior to PR being granted but his age is irrelevant once the application is received.

My application was received 6 days before my son's 22nd birthday and we just received PR - he landed 2 weeks ago. He is now 27!!

To reiterate, you must ensure your application is received by CIC before his 22nd birthday to "lock him in" at that age.
