Date of Common Law

Hi all,

I know this has been asked before, but I just need a little assistance.

I am sponsoring my boyfriend as my common-law partner. We officially moved in together 03/01/2013, but didn't sign a lease, and paid utilities in cash. We then didn't sign a lease until we moved to Germany in 2014, but only for a couple month then again have no proof of co-habitation.

We signed a lease here in Toronto in May 2015, so have been living together on that lease for over a year.

My question is, what date should I put in as our common-law date? I can get letters from friends stating that we lived in the same room with them, and have e-mail proof, and some other documents, but nothing solid.

I would go for the date you first started co-habiting and gather what evidence you can, PLUS include copies of lease agreements since that date, including your Toronto lease (that is the 'clincher'). That is the truth and you can prove the one year minimum anyway.....

I was thinking I'll struggle with the common law proof. Can you not both show statements of bills going to the same address to show you both lived at the same place at the same time? Would that be acceptable? I'm as much asking for me as the OP.

Have you looked at the new spousal application kit which was released today? The doc checklist is quite specific about requirements for proof of relationship. See the document checklist for sponsoring common law partners.
