Ah, ok. I should point out then for the sake of anybody else reading that it won't apply to most BE members, as it's only for people in the US - applying in person isn't possible at the London visa office.

ach ,friends son wants to visit me .hes 25 now and a straight arrow but at 18 he was done for driving wi no insurance ...50pound fine and had to resit driving test as he had not held licence for 2yr .+ points on licence.

silly boy took his dads car to his work when his car wouldnt start (2am) and he only had 3rd party ins.
does he need criminal rehab ???
dont know anything about this stuff ......

Unfortunately as with any legislation and guidelines there is no clear black and white procedures.
CIC has responsibility regarding Criminal Inadmissibility however CBSA officers at a POE are responsible for interpreting this and making a decision.
Determining the inadmissibility part is easy its the decision on if to admit or deny entry that is the hard part.
One has to read the CIC manual IP 1 in FULL to get a better understanding in particular sections 12 to 15 and in particular section 15.
Some POEs are very strict in their interpretation others not and this has always been a talking point.
With the recent OP bulletin 389

one can see that CIC are not focusing a high priority on minor criminal offences as they now instruct CBSA officers to issue a FREE TRP if warranted and meeting these guidelines.
In your case there is an argument to be made of admitting you however the examining officer will ultimately decide. One officer may issue one another wont.
I cant honestly say you wont be issued one neither can I say you will be issued one.

Acording to my research and some helpful advice on here is seems I am now deemed rehabilated but as I am such a worrier and going on a family holiday I have decided to apply to the embassy for information only. I feel I need that peice of mind before I book.

One question:

Do I need to still get court records and all the extra bits like references or could I just send then a copy of my APCO record with a covering letter and tick for information only?

Also what are the rough timescales for information only replies?

I have a question. I am from the US, charged with DUI in 1994. I paid all fines and such, have not had any other charges since.
I am going on an Alaskan cruise in August 2013 that departs from Vancouver. I am from WI, and we will be flying into Vancouver.

It sounds like if I filled out the paperwork for 'Application for Approval of Rehabilitation' it would not get processed in time for my trip.

What do you suggest I do?
Fill out the paperwork anyway and mail it in (along with the necessary $$)
Fill out the paperwork but 'For Information only' ?
Don't fill anything out but bring all necessary documents with me along with a completed form to show at the boarder?

I would appreciate any information someone can give. I am unsure what to do.

If you only have the one conviction for DUI in 1994 and you completed your sentence then you will be deemed rehabilitated. No need for any application.
If questioned about criminality you disclose the offence. If you have your court disposition (sentence rendered) then you could bring that along.
Based on that one conviction you are no longer inadmissible.

- Are there any other documents they require re:sentence/fine etc.

I will be forever grateful to yourselves if I can sort out this application successfully and be granted a rehabilitation ready for visa process....

I am going through the same procedure! How did it go for you? How long did it take to get the rehabilitation approval?

Just wanted to ask, what did you put on the statute number? and did you send memorandum of conviction certificate? I phoned the court today and they said after 7 years documents are archived and sometimes complete erased from their records! I commited the drink driving offence in 2004 and got my license back 9 months later ...
