"Criminal charges" please no judging
Hi. Everybody. Sensitive subject, please don't judge.
Just registered through BC PNP and received an "invite to apply".
1 of the questions is, Do have criminal convictions.?
I haven't done my police check yet and i only have 30 days to fill this out and send it.
8 years ago i was a licencee of a pub, and an alcoholic died the morning after drinking in my pub,(he was in his car in the car park on the premises)
I had to go to magistrate court and got find £160 after pleading guilty to "allowing the sale of alcohol to a person who was already drunk"
I believe this is a licensing conviction , not a criminal one
There was no suspended sentence or anything like that and they didn't even take my licence to serve
Away from me. Other than this i have never even had a speedy ticket.
Do i answer the question yes and give details. Or no
Any advice appreciated. Thanks so much for reading.

Saloon, tavern, and other licences are within Provincial jurisdiction.
There are criminal offences related to alcohol (eg drunk driving, public drunkenness causing a disturbance), but I suspect the equivalent offence to this in Canada would be against a Provincial statute, not the Criminal Code. This means it likely wouldn't be a problem for your application. If it'll appear on your ACRO however you may find it best to declare it, and point out you don't believe it's criminal - if the ACRO states anything other than "No Trace" you're probably looking at more paperwork anyway.

I haven't done my ACRO yet and it can take 6 weeks i believe. And i only have 30 days to get this in.

If it is a criminal offence in Canada (I've just had a quick search of the code but can't find anything similar, only had a quick look though) you'll need criminal rehab to enter Canada (even for a holiday), so you'll have to expect that to form part of your application. It may even be worth doing an 'info only' app as soon as you get your ACRO cert, to check that for sure, although you won't get the answer before you have to submit your PR app, but at least then you'll know one way or the other.
If there is nothing equatable that is punishable under Canadian law (even if provincial), then rehab won't be needed.

I too cant find anything under the Criminal Code of Canada nor under any other Act Of Parliament that would lead to finding you inadmissible for that offence.
