Contractor inUSA
 
Hi,
I am an Indian Citizen currently working as a CONSULTANT in USA for the past 2 years. Due to the nature of my job, I am not sure about my stay in USA but my current contract is going to end in Dec 2004. I want to apply for Canadian Permanent Residency and had a question regarding the same. If I start my application in Bufalo, USA and then I have to shift to India, will the file be shifted from USA to India or what can happen in that situation ? Also if the file is allowed to be shifted, will the processing start again or carry on from the place where it was in USA ?

Your file will remain in Buffalo and if interview is required but you can't
attend then you will risk refusal. Current law doesn't allow file transfers
unless integrity of the process requires it. Buffalo states that they don't
accept file transfer requests. If you are not sure that you can prepare a
flawless application package and conclusively prove all your claims without
leaving any room for officer's doubts, questions or interpretations in order
to have good chance for interview waiver then don't apply through Buffalo,
unless you have no problem getting US visa when needed.

If you are really that uncertain, you are better off filing your PR
application in New Delhi CHC.
The reason is that after the introduction of new laws, CHCs rarely transfer
cases any more.
This used to be more common in the pre-2002 days when applicants would
transfer their cases and lose very little time.
But that doesn't happen any more (or happens extremely rarely).
What may happen if you have to return to India is that your case would
continue processing at Buffalo CHC.
In case they ask for additional documents like current pay stubs, or proof
of current status in the US, you will have problems.
Also, if interview is required, you may not have US visa to attend
interview.
If everything goes well and your case is approved, you will still not be
able to submit your passports to Buffalo.

Because of all these reasons, it is better to file in CHC New Delhi.
Processing will be slower there, but you will never have any problems going
for interview or passport stamping because you are an Indian citizen.
