Confused. Alberta PNP or arranged employment?

Default Confused. Alberta PNP or arranged employment?

We are currently in Calgary 5/6 months into a 3 yr work permit in an occupation under pressure. We want to apply for PR and I am confused as to the best/quickest route.

As I see it (and I could be wrong) our options are:

1. Alberta PNP which company are happy to do

2. Skilled worker with arranged employment

3. Wait for canadian experience thingey

I had thought 1 was clearly best, but having seen some timelines etc is 2 actually better?

It's just number two.

If you're already here on a temporary work permit, I think a skilled worker application with arranged employment probably would be fastest. I'm going by the timelines that other posters have reported.

By the way, I should clarify that there are two kinds of skilled worker applications with arranged employment.

Well, the applications themselves are the same. What is different is the location of the person when he/she lodges the application.

If the person is in Canada, working on a temporary work permit, CIC seem to look very favourably on a skilled worker application backed up by a permanent job offer. They usually expedite an application like that, especially if it's an initial application and not an application that replaces a previously lodged application.

If the person has not yet entered Canada, but submits a skilled worker application backed up by an Arranged Employment Opinion, CIC is much more sceptical. According to Andrew Miller, some AEOs are fakes. That's not to say the AEOs themselves are forgeries or anything like that. But the job offers that underpin them sometimes are the results of favours, bribes, etc. Evidently CIC asks those kinds of applicants for additional documentation and scrutinizes their applications much more closely.

Hi Gryph

I would back up everything Judy says above, because that is what we did. We sent the initial application off just as Darren came out to start work, then sent a few pay slips and letter from the company confirming that it was a permanent job - you could do this with your initial application as you will already have the pay slips and can get a letter, so that will speed yours up even more.

We did that at the beginning of July, got a letter telling us to go for medicals in August, which we did in September, got the letter requesting passports in October and went down to the border at Carway to land as PRs on 24th November.

If you have already got all the info, police checks etc, it should be a relatively easy process. Good luck!

Just to further this question.
When applying for PR with PNP, do they score the Federal PR application in the same way as they do a Federal PR application without PNP? i.e the 67 points requirement etc...

No, each province's PNP uses its own criteria.

Selection decision is made by PNP and at federal stage there is nothing to count anymore.

Of course in some rare cases processing officer may not agree with PNP selection certificate and refuse case on the basis of R87(3) here:

Substitution of evaluation

(3) If the fact that the foreign national is named in a certificate referred to in paragraph (2)(a) is not a sufficient indicator of whether they may become economically established in Canada and an officer has consulted the government that issued the certificate, the officer may substitute for the criteria set out in subsection (2) their evaluation of the likelihood of the ability of the foreign national to become economically established in Canada.


So, there is no more selection process for PNP case at the federal stage, but the above requires officer to assess applicant's chances for successful establishment in Canada anyway.

Note - Quebec Selection certificate holders are not subject to the above 'Substitute Evaluation", it applies only to PNP cases.

Thanks everyone. It does seem clear that if we were ready to go now, that fast track would be better. But we aren't as we still have to get letters of employmnet, police checks (inc one from Aus) and so we are reviewing the PNP forms and seeing if we can get those out super quick, and then get all the other stuff together whilst waiting for PNP forms.
