Default Common-Law

What is it?
My husband lived with a previous girlfriend for over a year, but never a full tax year. The lease was in both of their names, but the telephone bill etc were separate.
When he filled the tax return for the year he did not write that he was in any sort of relationship, and the only other thing linking them together was she was a casual driver on his car insurance.
Does he need to get proof of the severence of this union at all? Or were they never "legally" together?

Thanks for any help, if we need to track her down it may take us a little longer to file........
