Default Citizenship for baby question?

Hi Everyone

Bit of a complicated query here so not sure if anyone on the forum can advise.

Here is the background to the query:

My husband and I have been Permanent Residents since Aug 2009 so will be eligible to apply for citizenship late 2012 (due to days spent outside of Canada during the 3 years). We have a 7 month old son born in Toronto who is a Canadian citizen.

We are not sure of our plans for the next few years but may move back to the UK after applying for citizenship. We are aware that we would need to be available for interview/test etc and need a Canadian contact address should we move back to UK while in the citizenship application process.

We would like to have a 2nd child and of course would want him/her to be a Canadian citizenship like their sibling (and us). Our move back to the UK will be dependent on a securing a job so that will be the deciding factor and as much as you want to plan when to have a child, it doesn't always work out when you want it!

So my query is:

1. If we do move back to the UK before our 2nd child is born and we are in the process for applying for citizenship, what would be the status of our child?

2. Would the fact their sibling is a Canadian citizen make a difference for a child born outside of Canada?

We do realise that it would be better to stay in Canada until we have had a our 2nd child but one of the main reasons for moving back is to get family support as it has been so tough not having family out here with a baby and of course having 2 is even more difficult!

I know this query is not strictly related to immigration but know citizenship stuff is on this part of the forum but please feel free to move is better on difference part of forum.

If you give birth outside Canada before becoming citizens the child has no status in Canada.

Though once you become Canadians it is possible, though a right ol' faff and quite expensive for him/her to become a citizen. You need to sponsor the child for PR, enter Canada for the child to become a PR and then you can immediately apply for citizenship for the child. Note though that when sponsoring a relative for PR you should have the intention of returning permanently to Canada.

It is also possible to sponsor the child for PR before you become citizens, but one of you has to be in Canada to do this, so given what you've said that doesn't seem sensible.

Much simpler to give birth after acquiring citizenship: just need to apply to the High Commission in London for a Citizenship Certificate.

Thanks for info BTJ.

Of course the ideal scenario would be have baby here and then move back a few months later so automatically a citizen like son but of course timing is never perfect.

Least know it is possible although albeit a bureaucratic nightmare. Hopefully won't have to cross that bridge (possibly literally!!!) but just wanted to check options as that info not available via CIC.

I guess this part in the link isnt clear enough

Minors: Parents or legal guardians may apply for citizenship on behalf of a minor (under 18 years of age) as soon as the minor receives permanent resident status. To apply on behalf of a minor, one parent must already be a Canadian citizen or must be applying to become a citizen at the same time.

Sorry I didn't really read that thoroughly so thanks for highlighting info. Must be baby brain or just not having the time to read things properly anymore!!!

Def sounds like something to avoid if possible but if needs must!
